Compensatory Leave

Regular Compensatory Leave

Career Service employees who do not receive overtime pay for additional hours worked in a regular pay period may receive regular compensatory leave credits equal to each additional hour worked, up to 240 hours. These leave credits may be used to take time off from work for various personal reasons. Regular Compensatory leave credits have no cash value and are granted on a “use it or lose it’ basis.

Special Compensatory Leave

Career Service employees may earn special compensatory leave credits equal to each additional hour they are required to work during a state holiday or a work period containing a state holiday. Additionally, Career Service employees and Selected Exempt Service employees below the Bureau Chief (or comparable) level may earn special compensatory leave credits equal to each additional hour they are required to work during an emergency office closure. These leave credits may be used to take time off from work for various personal reasons. Unused credits may or may not have cash value depending on the terms and conditions of the employee's position or collective bargaining unit.

FLSA Compensatory Leave

Career Service and Select Exempt Service employees who normally receive overtime pay for additional hours worked may instead elect to receive compensatory leave credits equal to one and one-half of each additional hour worked, if the employing agency has adopted an FLSA Compensatory Leave plan in accordance with the Fair Labor Standards Act (FLSA). These leave credits may be used to take time off from work for various personal reasons. FLSA compensatory leave credits have cash value if not used and unused credits will be paid in accordance with the agency's plan.
